These terms govern your use of Fishinary, operated by AnyLuck LLC ("we", "us"), a California limited liability company. By creating an account or using the app, you agree to them and to our Privacy Policy. If you do not agree, do not use Fishinary.
You must be at least 13 years old to use Fishinary — at least 14 if you live in South Korea, and older where your country's law requires. If you are under the age of majority where you live, you may use Fishinary only with the involvement of a parent or guardian, who agrees to these terms on your behalf. You may not use Fishinary if the laws of your country, or United States export and sanctions laws, prohibit it.
You are responsible for activity under your account and for keeping your credentials secure. Provide accurate information when signing up, and tell us promptly at support@fishinary.com if you believe your account has been compromised. One person may not maintain multiple accounts to gain an advantage in rankings or rewards.
You keep ownership of the photos and information you upload. You grant us a non-exclusive, worldwide, royalty-free license to store, reproduce, process, and display that content solely to operate and improve Fishinary — including making reduced-size copies, sending photos to our automated species-identification provider, and displaying your content to other users according to the sharing settings you choose.
You confirm that you own or have permission to upload what you submit, and that it does not infringe anyone's rights. This license ends when you delete the content or your account, except for copies already distributed to other users under your sharing settings and copies retained in routine backups until purged.
You agree not to:
When you submit a catch photo, automated analysis identifies the species, estimates size, and checks whether the photo shows a real, fresh catch. The result is one of three outcomes: accepted; flagged, which keeps the catch in your log with full credit but leaves it out of rankings; or not accepted, which means the catch cannot be logged. A "not accepted" result is an automated decision. You can ask a person to review it from the same screen ("This is a real catch — submit for review"); a member of our team looks at the photo and the result appears in the app. We also compare photos with earlier submissions to detect duplicates, and only catches that meet the verification rules shown in the app appear in rankings.
Any user can report a catch or block another user. A person reviews every report. Reports are confidential and are never shown to the person reported. If we remove content, we tell its owner in the app with the reason and how to contest the decision by email. We may remove content that violates these terms, and we may suspend or terminate accounts for repeated or serious violations, for repeated copyright infringement, or for conduct that creates risk for other users or for us.
Online safety. Reporting, blocking, our review of reports, the eligibility age above and the acceptable-use rules are how we protect users — including users under 18 — from illegal content and from content that could harm them. Complaints about how we handled a report, or about content you believe should not have been removed, go to support@fishinary.com.
Coins, experience, levels, badges, titles, callsigns, and other in-app items are a limited license to use digital content within Fishinary. They have no monetary value, cannot be redeemed for cash, and cannot be transferred or sold outside the app. We may adjust rewards, pricing, or availability, and unused items are forfeited when an account is closed. Any purchases are processed by Apple or Google and are subject to their refund policies.
Using Fishinary requires a subscription, billed by Apple or Google through your App Store or Google Play account. The plans, prices and any free trial are shown before you subscribe. A subscription renews automatically at the end of each period until you cancel, and a free trial becomes a paid subscription unless you cancel before it ends.
You can cancel anytime in your App Store or Google Play subscription settings. Cancelling stops the next renewal; you keep access until the end of the period you have paid for. Refunds are handled by Apple or Google under their policies. Deleting your account doesn't cancel a subscription.
Fishinary is distributed through Apple's App Store and Google Play. These terms are between you and AnyLuck LLC only. Apple and Google are not parties to them, do not own or control Fishinary, and have no obligation to provide maintenance or support for it; we alone are responsible for the app, its content and its support. Your license to use Fishinary (section 19) is limited to devices you own or control; on Apple devices it is also limited to Apple-branded devices and to the usage rules in the App Store Terms of Service, including through Family Sharing where Apple allows it.
If Fishinary fails to meet a warranty that applies to it, you may notify Apple, and Apple will refund any purchase price you paid Apple for the app; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple or Google, are responsible for any claim relating to the app or your use of it — including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, and claims that it infringes someone's intellectual property, which we will investigate, defend, settle and discharge.
You represent that you are not located in a country subject to a United States government embargo or designated by the United States government as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties. You must also comply with any third-party terms that apply to your use of Fishinary, such as your mobile carrier's. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Purchases through Google Play are also subject to the Google Play Terms of Service. We respect intellectual property and expect our users to do the same. If you believe content in Fishinary infringes a copyright you own or represent, send a notice to our designated copyright agent — Copyright Agent, AnyLuck LLC, 2108 N St, Ste N, Sacramento, CA 95816, United States, telephone +1 951-254-2602, support@fishinary.com — containing: (1) your name, address, telephone number and email; (2) identification of the copyrighted work; (3) identification of the content you say infringes it and where it appears in the app — a username and the catch is enough; (4) a statement that you believe in good faith that the use is not authorized by the owner, its agent or the law; (5) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and (6) your physical or electronic signature. We remove or disable access to content identified in a valid notice, notify the user who posted it, and accept counter-notices that meet the requirements of 17 U.S.C. § 512(g). We close the accounts of users who repeatedly infringe. Notices from outside the United States may follow the same steps.
Fishinary is a logging and entertainment tool, not a source of legal or safety guidance. You are solely responsible for knowing and obeying all fishing regulations that apply to you — licensing, seasons, size and bag limits, protected species, and access rules — and for your own safety on or near the water. Species identifications, size estimates, and bite forecasts are automated estimates that may be wrong, and must never be relied on to determine whether a catch is legal.
We work to keep Fishinary running but do not guarantee uninterrupted availability, and we are not responsible for loss caused by events outside our reasonable control. Keep your own copies of photos that matter to you. We may change features, and may add, alter or remove content such as species data and virtual items. If we discontinue Fishinary, or remove a feature central to it, we will tell you in advance where we reasonably can; your subscription can always be cancelled in your App Store or Google Play settings, and your statutory rights are unaffected.
You may stop using Fishinary and delete your account at any time (Settings → Account → Delete Account). We may suspend or terminate an account that violates these terms or creates risk for other users or for us; where the law requires, we will tell you why and how to object. Sections that by their nature should survive — on your content, acceptable use, disclaimers, liability, indemnity, disputes and general terms — survive termination.
Nothing in these terms limits any right the law gives you as a consumer that cannot be limited by contract — including under the consumer laws of the European Union and its member states, the United Kingdom, Australia, New Zealand, Canada, Brazil, Japan and South Korea. Where a provision below conflicts with such a right, the right prevails. For consumers in Australia: our services come with guarantees that cannot be excluded under the Australian Consumer Law, and sections 14 to 16 apply only to the extent that law permits.
Fishinary is provided "as is" and "as available." To the extent permitted by law, we make no warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Species identifications, size estimates, bite forecasts, weather and map data are automated or third-party estimates that may be wrong (section 10).
To the extent permitted by law, AnyLuck LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data or goodwill, and our total liability for all claims relating to Fishinary is limited to the greater of the amount you paid for your subscription in the twelve months before the claim or fifty US dollars. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that the law does not allow to be excluded or limited.
To the extent permitted by law, you agree to indemnify AnyLuck LLC against third-party claims arising from your content, your misuse of Fishinary, or your violation of these terms or of applicable law.
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and disputes will be brought in the state or federal courts located in California — except that if you are a consumer in the European Union, the United Kingdom, Australia, New Zealand, Canada, Brazil, Japan, South Korea or another country whose law lets you rely on your own country's mandatory consumer law and bring or defend claims in your own courts, those rights are unaffected. Before starting any claim, you agree to contact us at support@fishinary.com and give us 30 days to try to resolve it informally. Either of us may bring an individual claim in a small-claims court that has jurisdiction.
We may update these terms. For material changes we will give at least 30 days' notice in the app or by email before they take effect, and the date at the top of this page will change. If you do not agree to a change, cancel your subscription in your App Store or Google Play settings before the change takes effect and stop using Fishinary; you keep access until the end of the period you have paid for. Changes required by law, or that only add features or fix errors, may take effect sooner.
Your license. Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Fishinary on devices you own or control, for your personal, non-commercial use. Fishinary — its software, design, text, species data, artwork and trademarks — belongs to AnyLuck LLC or its licensors and is protected by intellectual property laws; these terms give you no other rights in it.
Feedback. If you send us ideas or suggestions, we may use them without any obligation to you. Third-party services. Maps, place names, weather and sign-in are provided by third parties under their own terms; we are not responsible for their content or availability. Assignment. You may not transfer your account or these terms to anyone else. We may assign them to a successor to our business and will tell you if we do. Severability and waiver. If a provision is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. Entire agreement. These terms, our Privacy Policy and the applicable store terms are the entire agreement between you and us about Fishinary. Events outside our control. Neither of us is responsible for delay or failure caused by events beyond reasonable control. Language. These terms are written in English. Translations are provided for convenience; where the law allows, the English version prevails. Notices. We may notify you in the app or at the email address on your account. Notices to us go to the addresses in section 20.
